Acceptance of terms and conditions

On this website ("site"), Antihumedades ("www.antihumedades.es") makes available to its users a set of information, documents, and products (globally, "materials") as well as various services ("services") whose use is subject to the terms and conditions contained in this document. The fact of accessing this site implies that you accept each and every one of these conditions of use.
Antihumedades reserves the right to periodically modify these conditions, if it deems it appropriate. Your use of this site will always be subject to the most recent conditions of use included on the site itself at the time of its utilization. The use of any material or service contained on this site will be carried out in accordance with the specific rules and conditions of each material or service, in addition to the rules contained in these conditions of use. All of those rules are formally incorporated by reference into the conditions of use. Failure to comply with any of the conditions of use implies the immediate termination of your authorization to use it and the obligation to destroy any material that has been downloaded or printed from this site.

I. Purpose, object, and scope of application

These provisions regulate the contracting of products and services offered and the advertising directed at its clients/users by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. a commercial company operating through the Internet from its website (antihumedades.es) offering its clients anti-humidity, waterproofing, and water-repellent products, as well as any other products it may add to its range in the future. These General Conditions also regulate the rights and obligations of the parties derived from the purchase and sale operations concluded between them.

The clauses listed below configure the framework contract that all users accessing the antihumedades.es page are obliged to know and accept. For the sole purposes of these general conditions, the expression "user" comprises any internet user who accesses the website antihumedades.es, either directly or from any other Internet site.

The services offered by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. on this website will be regulated by the conditions contained in this contract. AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. reserves the right to modify, totally or partially, these general conditions, the new ones agreed upon being applicable from the moment of their publication on the page. In any case, the aforementioned modifications will not have retroactive effects on goods or services previously contracted by users.

These General Conditions bind both parties and form an integral and inseparable part of the purchase and sale contract, whose efficacy operates at the moment the order is placed at the client's request, through the contracting mechanisms that will be specified later, all in accordance with the provisions of art. 1,255 of the Civil Code, which embodies the principle of autonomy of the will and agreements between the contracting parties. For all purposes, it will be understood that the user accepts the conditions and rules of use listed here if they click the "Accept" button that appears at the bottom of this document.

To fully guarantee the rights of consumers and users of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., these General Conditions are established in accordance with the provisions of Spanish law, and in particular in Law 7/98 of April 13 on General Contracting Conditions, Law 7/96 of January 15 on the Regulation of Retail Trade, the Civil Code, Directive 2000/31 EC of the European Parliament and of the Council of June 8, Law 34/2002 of July 11 on services of the information society and electronic commerce, Law 3/2014 of March 27 which modifies the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007 of November 16 (hereinafter, LGDCU) and other applicable laws and their regulatory developments.

III.- Legal conditions of Service Provision and responsibility

Clarity and transparency in information:

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., in compliance with the provisions of art. 10 of Law 34/2002 of July 11, through its website and these General Conditions, enables permanent, easy, direct, and free access by electronic means to comprehensive information regarding its company name (fiscal and registration data, address, and communications address), as well as to client data, which is exclusively accessible to them and is held by the company.

Likewise, in accordance with the aforementioned LGDCU, it offers the client both pre-contractual information (see these General Conditions as well as additional information in the different sections of the website) and the confirmation of the information required legally.

IV.- Conditions of access for the user/client

The user of the website of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. shall have the right to free and open access to the public information gathered therein, although AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. reserves the right to restrict access to information, promotions, and special offers to its registered clients.

Any user who accesses the website of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. has the right to register as a client, thereby being able to benefit from special offers intended for the group of registered clients if they comply with the specific conditions of the offer specified for each product.

User registration:

The client/user, prior to formalizing the purchase of any of the products offered by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. must register their personal details and circumstances necessary for the formalization of the purchase and sale contract (first name and surname or company name, DNI/NIF, address, email address, telephone/fax number).

The user may only contract and place orders if they are of legal age. Otherwise, the responsibility for placing orders by minors will fall upon the parents or legal guardians of the minor.

To be able to place orders on the website, each client will voluntarily and under their responsibility provide AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. with their personal data. All personal data provided by clients fraudulently or falsely may be considered a crime of falsification of commercial documents.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. may offer the client a personal registration system through a personalized access key (login) and a password to facilitate future purchase operations for the client. In such a case, the client may designate the desired username and password at their discretion, provided they are available or not assigned to other clients. Through an automatic process, AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., if the client so desires, will generate the access key and password for the client. Usernames or passwords with immoral, offensive, defamatory, discriminatory content or content that contravenes the provisions of the law will not be accepted, nor will those with terms that elude to brands, products, or names protected by legal provisions on Intellectual or Industrial Property, or contrary to the rights to privacy, honor, and one personal image.

The client undertakes to ensure the confidentiality of their own access key and password. AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. is exempted from any liability derived from the incorrect use or negligence by the client in complying with their confidentiality obligation regarding their access keys.

In accordance with the provisions of the LGDCU, we inform that AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. is a company adhered to the alternative dispute resolution system of Confianza Online. V.- Offer and acceptance process

PRODUCT PURCHASE-SALE CONDITIONS

Pricing policy:

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. reserves the right at any time and unilaterally to modify the price of the products and services offered through its website. To guarantee the certainty and security of the price of its products to the client, the valid price will be the one in the advertisement matching the moment the order is formalized.

In the electronic purchase process, the following steps will be followed according to the menu of options stated on the website:

1.- Information about the product offered to the client:
Includes technical characteristics, description, warranty period, manufacturer brand, guideline photograph.

2.- Information about the price of the product:
Information on the final price or retail price of the product to be acquired, containing within the same order the cost for the client without including VAT, shipping costs, and cargo insurance and handling derived from transport. The final cost will be communicated to the client during the electronic purchase process before they formalize their acceptance by choosing the order acceptance option.

3.- Possible discounts or promotional gifts will be freely directed by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. to the groups designated at each moment by the company, or depending on the product offered, according to the advertising existing at each moment on its website.

Order acceptance:

At the moment of formalization of the order, once the order acceptance menu option is utilized, the client's consent is understood as given for the validity and efficacy of the purchase and sale contract that binds the parties. Antihumedades.es will electronically store the order, except for reasonable typographical errors, in which case the order cannot be processed.

2 emails are sent, one addressed to soluciones@antihumedades.es and another to the client.

The client will be responsible for checking that the data in the email with the order are correct, both in personal data and order details.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., after acceptance of the order, will inform the client of it by sending the order confirmation and also sending the general conditions currently in force of Antihumedades.es to the email indicated by the client.

The commitment acquired by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. for the sale and delivery of the offered merchandise remains subject to the stock of the advertised product and its availability until stocks run out, which is why AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., in its commitment to quality and customer service, tries at all times to ensure that advertised products are available. However, should exceptional circumstances occur such as an abusive order, interactive multi-order, or those others that cause the product to run out of stock, the order and the contract signed between the parties will remain without effect by virtue of this termination clause, fully restoring to the client, in the case of prepayment, the amounts paid by them.

Important note for the purchase of "Opportunities": AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. may offer products in this section originating from customer returns or with some non-significant flaw for its operation (e.g., non-original packaging) which will be described exactly and meticulously in the item's description. All products in this category are completely new except those specifically indicated in their description not to be so. For the latter, AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will respond to any lack of conformity within a period of one year from delivery (according to the period recognized for this type of products in the LGDCU), presuming that lacks of conformity during the first six months already existed when the good was delivered (except when this presumption is incompatible with the nature of the product or the nature of the lack of conformity), corresponding to the buyer to prove in the remaining 6 months that the lack of conformity already existed at the moment of delivery.

Product images are not contractual and are subject to change by the manufacturer.

Payment methods by the client:

The following payment systems are established:

1st.- Transfer

These payment methods consist of a bank transfer or cash deposit of the full amount of the order in favor of the bank account owned by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. in both payment modalities with express mention of the order number linked to the payment. Orders with these payment methods that are not settled in the account of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. within 5 days after order confirmation will be automatically canceled after the expiry of said period. The established value limit is EUR 5,000 per order. In case of exceeding this amount, the client must communicate via email. It is important to remember that some banks can take 1-2 business days to make the transfer effective, and account deposits can take a minimum of 24 hours to be reflected in our system.

2nd.- Credit card

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. accepts payments with VISA, Verified by VISA, MasterCard, MasterCard SecureCode. The banking entity that issues the card must be located within Spanish territory.

When making the order, the client will provide their card details, which will be stored directly in Wirecard during the purchase process. AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. does not store information regarding credit cards.

The purchase limit per order with a credit card is €3,000.

3rd.- PayPal

The client may pay for their order through the PayPal payment system.

4th.- Cash on delivery (Contra reembolso)

The client will make the full payment in cash at the moment of delivery of the merchandise at the place designated by them when placing the order.
AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. reserves the title and will retain full ownership of the item until full payment by the client, including possible errors of the seller or carrier thereof. The minimum amount for an order with the "cash on delivery" payment method will be EUR 50. The purchase limit with the "cash on delivery" payment method will be EUR 999.99 (VAT incl.) per order. The purchase for cash on delivery will have an additional cost of 3% (with a minimum of €3) on the total purchase amount.

Invoice:

Antihumedades.es will issue a physical invoice which it will send and deliver together with the order to the client's designated address.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. warns that it will not be able to modify sales invoices subsequent to billing in compliance with current regulations (Royal Decree 1496/2003 on Billing rules, modified by Royal Decree 87/2005). The invoice will be issued in the name of the natural person or company making the order, so the client must ensure that they make the order in the correct name. Subsequent changes will not be possible.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. warns that, for reasons of personal data protection, duplicate invoices will only be issued to the holder of the contract. Duplicates will not be issued to third parties. AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will not send duplicate invoices by fax or email, but only to the address designated by the holder of the contract. Once the warranty period has expired, no further duplicate invoices can be issued.

VI.- Product Warranty

The warranty of the products sold by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. is provided and established by virtue of the regulations contained in the legislation in force, in particular, in the aforementioned LGDCU, a legal framework whose purpose is to provide the consumer with different options to demand remedy when the acquired good is not in conformity with the contract, giving them the option to demand return or replacement of the good, unless one of these turns out to be impossible or disproportionate. When return or replacement are not possible or turn out to be disproportionate, the consumer may demand a price reduction.

Commercial warranty:

Manufacturers may offer additional warranties, whose extent and duration differ according to products and brands. Said warranties will be exclusively at the expense of the manufacturer bound by them.

In electronic equipment, the warranty includes parts and labor for 3 years in accordance with current legislation.

Costs of transport, assembly, and installation or home replacement are not included in the commercial warranty of electronic equipment.

By virtue of the LGDCU, the seller is obliged to deliver to the consumer a good that is in conformity with the contract of purchase and sale under the terms established by the same, by virtue of which:

"The seller is obliged to deliver to the consumer and user products that are in conformity with the contract, responding to them for any lack of conformity that exists at the moment of product delivery."

In any case, the serial number of the product to be repaired must correspond with the one listed in the records of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will not be held responsible for possible damages that may result from misuse, manipulation, non-professional installation, or malfunction. Damages caused by floods, pests, earthquakes, actions of third parties, or any other causes of force majeure outside normal conditions are also excluded from the warranty. The warranty will not be valid in case of factors external to the normal use of the product, such as voltage surges or drops, use of accessories inadequate or prohibited by the manufacturers, drops, fire, or incorrect or abusive handling by the client or by unauthorized third parties.

The calculation of the warranty will commence on the day of delivery, by virtue of the LGDCU.

Without prejudice to the remedy regime described above, and even in case of full conformity of the good, the client may withdraw from their order and return it within fourteen business days, as indicated in the following sections.

The warranty is directed solely to the holder (contractual party) appearing on the invoice and only the holder may demand it.

AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U will not be responsible for attending to requirements from third parties who have not directly acquired the good through AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U and/or who do not appear on the sales invoice.

Antihumedades.es and its manufacturers guarantee that their products are free from defects in their manufacturing until their expiration date and comply with the specifications provided in their respective technical data sheets. Due to the fact that conditions such as: surface preparation, product preparation or mixing, labor, weather, structural aspects, site conditions among others, are outside the knowledge and control of the seller and the manufacturers, it is not guaranteed that optimal results will be obtained in their application. The Buyer may agree to conformity in order to obtain advice from qualified professionals and determine by themselves the feasibility of using the products, assuming all risks themselves as the buyer. The execution of the warranty for the Buyer is limited exclusively to the replacement of products proven to be defective or, at the seller's option, to refunding the price paid, if so determined by the technical service of the seller and/or the manufacturers. The product warranty is limited. No other warranty, express or implied, shall apply, including any warranty of merchantability or fitness for a particular purpose. The seller or the manufacturer will not be liable under any legal circumstance or legal theory for any damage caused. No representative of the seller has the authority to make or give provisions except those described herein. The seller or the manufacturers reserve the right to change the properties of the products without prior notice.

VII.- Client rights

Confidentiality and security of the client's personal data in accordance with the provisions of current Spanish legislation on data protection. No dissemination, transmission, or publication of client data without their express consent.

Not receiving promotional or advertising emails in case of having rejected them.

Accessing, rectifying, canceling, and/or objecting to the processing of the client's personal data held in the database of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U at the client's request, all in accordance with the provisions in the section on Personal Data Protection.

Free access to the open sections of the website of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U.

Knowing at all times the processing status of the placed order. Withdrawing from this contract within a period of 14 business days without need for justification.

The withdrawal period will expire 14 business days from the day that the client*, or a third party indicated by them, other than the carrier, acquired physical possession of the goods.

To exercise the right of withdrawal, you must notify AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. (Address: Plaza Estación 4 – Bajo – 36600 – Vilagarcía de Arousa, Pontevedra, Spain) via telephone: 881 97 61 73 or Email: soluciones@antihumedades.es of your decision to withdraw from the contract.

You may likewise make an unequivocal statement of your decision through a letter sent by postal mail or fax. You may use the model withdrawal form that we will provide, although its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for the communication concerning your exercise of this right to be sent before the corresponding period expires.

Consequences of withdrawal:

In case of withdrawal, we will return all payments received, deducting the original shipping costs (service effectively consumed) and return and/or transport costs, without any undue delay and, in any case, no later than 14 calendar days from the date on which we are informed of the decision to withdraw from this contract.

We will proceed to carry out said reimbursement using the same means of payment used for the initial transaction, unless the client has expressly arranged otherwise; in any case, you will not incur any expenses as a consequence of the reimbursement.

* Important: Natural or legal persons acting in a field outside a business or professional activity will be considered consumers. AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will not accept returns due to withdrawal by companies or professionals.

According to Law 3/2014, withdrawal is not appropriate and cannot be exercised (except for error or defect in the contracted product) in the following cases provided for by article 103 (Exceptions to the right of withdrawal).

Demolition Expansive Cement, due to its high environmental sensitivity to humidity and its short expiration period (30 days from manufacture) is excluded from the right of return, except for damages or defects in product delivery.

Exceptions to the right of withdrawal

Article 103 of Law 3/2014 on Consumer Rights

The right of withdrawal will not be applicable to contracts that refer to:

a) The provision of services, once the service has been fully executed, when execution has begun, with the prior express consent of the consumer and user and with the acknowledgment on their part that they are aware that, once the contract has been fully executed by the entrepreneur, they will have lost their right of withdrawal.

b) The supply of goods or provision of services whose price depends on fluctuations of the financial market that the entrepreneur cannot control and that may occur during the withdrawal period.

c) The supply of goods made according to the specifications of the consumer and user or clearly personalized.

d) The supply of goods that may deteriorate or expire rapidly.

e) The supply of sealed goods that are not suitable to be returned for reasons of health protection or hygiene and that have been unsealed after delivery.

f) The supply of goods that after their delivery and taking into account their nature have been mixed inseparably with other goods.

Return conditions:

In cases of wear or deterioration of the good due to causes that are not exclusively due to its testing to make a final decision on its acquisition, AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will agree with the client on the amount to be refunded.

Below we attach the table with the amounts corresponding to return costs depending on the product. The client will only be responsible for the decrease in value of the goods resulting from handling other than that necessary to establish the nature, characteristics, and functioning of the goods. In cases of excessive use of the good, said return will not be accepted. We request that before using the product, you decide whether you are genuinely interested in it.

Shipping and special conditions

Important:

• The return of amounts will be made through the same means of payment by which the collection was made, with the exception of expenses generated by cash on deliveries which will be paid via transfer.
• All returned products must be delivered in their original packaging. Damage to the original packaging has a cost of €25 which will be deducted from the amount to be returned to the client.
• Any extra cost of the return of the merchandise will fall upon the client, this amount being deducted from the quantity to be returned to the client.
• In the case of incorrect applications of the products, returns or claims will not be admitted. Any doubt or query must be made priorly to our technical department: Telephone and WhatsApp: 698 12 66 20 or email: tecnico@antihumedades.es
• Works carried out for the application, use, or installation of any product or machine sold through Antihumedades.es cannot represent an object of claim by the client towards the selling party, and the client expressly waives any subsequent report or claim for damages, even in the event of product or machine return. The manufacturers' warranty only covers manufacturing defects of their products, not inadequate, incorrect, or improper application.
• AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. will not take charge of returns on products manipulated by the client, or those goods returned incomplete in both their main and accessory elements. The right of withdrawal will not apply outside the indicated period, nor on products subject to fluctuations of a market not controlled by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U., nor on perishable items. Neither will withdrawal apply to goods or orders that can be considered due to their special characteristics as made-to-measure as requested by the client.

Instructions for shipping (returning) products:

The delivery of a possible return will not be managed directly at our facilities, but will be delivered to the carrier for shipment. We inform that, to avoid any incident, it is necessary for smaller products to be protected by an additional external packaging - just as you received it at your home - and thus avoid any type of damage or manipulation of the product's original packaging during transport. For larger products, external packaging protecting the original is not indispensable; nevertheless, it is important that you ensure the product is sent duly protected inside the original box with the protections intended for this purpose (corks, styrofoam, bubble wrap, etc.) and avoiding any type of manipulation on it.

All returns of products that do not have the original packaging will be rejected. Please note that in order to agilely identify your return, it must contain the original return form from AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U.

VIII.- Obligations of the user/client

Keep their personal keys with due diligence.

Faithfully use the shopping service provided by AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U. on its website, abstaining from manipulating the contents of its website, introducing degrading contents, or interfering with its computer systems through viruses or other behaviors prohibited by Law.

Respect the purchase agreement once the order is accepted, with the timely payment of the agreed price, and abstain from carrying out abusive and unlawful behaviors in contracting.

Exclusively use the information published by Antihumedades within the intended personal commercial relationship.

Not reproduce, alienate, or dispose of the information published by Antihumedades in all its contents without express permission from the company itself.

IX.- Rights of AFANA IDEAS INNOVACION Y SOLUCIONES INTELIGENTES S.L.U.

• Retain, modify, or suspend its website without prior notice.
• Modify the price of offers.
• Reject orders due to lack of stock or non-payment by the client.
• Collect the amount of purchases from the client once the transaction is accepted.
• Reserve title and retain full ownership of the item until full payment by the client.

X.- Intellectual and industrial property rights
